Retail Electric Providers’ (REPs’) Compliance Filings for new SUBST. R. 25.107
New P.U.C. SUBST. R. §25.107, which became effective on May 21, 2009, established additional financial, technical and managerial requirements for Retail Electric Providers (REP). Pursuant to P.U.C. SUBST. R. 25.107(k)(1), REPs that obtained certification before May 21, 2009 and that did not meet all of the requirements of P.U.C. SUBST. R. 25.107 as adopted on May 21, 2009 were allowed to operate for not more than 12 months under the old rule. Under P.U.C. SUBST. R. 25.107(k)(2), REPs are required to notify the commission that they meet the requirements of the new rule and to provide documentation to the commission to substantiate the notification. To facilitate the gathering of this information, the commission has opened Project No. 37957—Retail Electric Providers’ (REPs’) Compliance Filings for new SUBST. R. 25.107. REPs may file their notification and supporting documentation required under Subst. R. 25.107(k)(2) in this project for Staff’s review.
REPs must address compliance with the financial requirements of P.U.C. SUBST. R. §25.107(f)(1), related to access to capital, P.U.C. SUBST. R. §25.107(f)(2), related to customer deposits, P.U.C. SUBST. R. §25.107(g)(1)(D), related to 15 years of managerial experience in the competitive electric and/or gas industries, and P.U.C. SUBST. R. §25.107(g)(1)(E), related to energy commodity risk experience.
