Rulemaking to Establish Billing Demand for Certain Utility Customers Pursuant to PURA §36.009
This rulemaking implements Public Utility Regulatory Act (PURA) §36.009 and applies to transmission and distribution utilities (TDUs) that provide retail distribution service in the ERCOT competitive market. TDUs shall be required to waive the application of the demand ratchet provisions of their approved tariffs for each nonresidential secondary service customer that has a maximum load factor equal to or below a factor set by commission rule.

The adopted rules will be published in the Texas Register on June 8, 2012.
The effective date of the rules is June 12, 2012.
