Project No. 42330, Rulemaking to Propose New Procedural Rule 22.146, Relating to Limitations on Discovery in Rate Proceedings has been established for this proceeding.
The draft rule will contain changes pertaining to limiting discovery in rate proceedings by requiring the presiding officer to adopt a discovery control plan, taking into consideration: 1) the discovery period; 2) the alignment of the parties; and 3) reasonable limits that would prohibit duplicative, unnecessary, or harassing discovery.
