The draft rule will contain changes pertaining to limiting discovery in rate proceedings by requiring the presiding officer to adopt a discovery control plan, taking into consideration: 1) the discovery period; 2) the alignment of the parties; and 3) reasonable limits that would prohibit duplicative, unnecessary, or harassing discovery.

Staff invites comments on this draft rule. Initial comments may be submitted by May 20, 2014, and reply comments may be submitted by May 27, 2014. Sixteen copies of comments on the proposed section are required to be filed pursuant to P.U.C. Proc. R. 22.71(c)(13) with the Filing Clerk, Public Utility Commission of Texas, 1701 North Congress Avenue, P.O. Box 13326, Austin, Texas 78711-3326. All comments should refer to Project Number 42330.
The Staff of the Public Utility Commission of Texas will hold a workshop on Monday, June 9, 2014 to discuss changes to Subchapter H of the Commission's Procedural Rules relating to limitations on discovery in rate proceedings. The workshop will begin at 10:00 A.M., in the Commissioners' Hearing Room, located on the 7th floor of the William B. Travis Building, 1701 N. Congress Ave., Austin, Texas.
