Rulemaking Proceeding to Amend 16 Tex. Admin. Code §25.192, Relating to Transmission Service Rates

Summary

This rulemaking proposes amendments to 16 Tex. Admin. Code §25.193, relating to Transmission Service Rates, to update the rule to conform to the current industrial and regulatory environment. Specifically, proposed amendments include the following changes: explicitly defining certain terms; inclusion of offsetting transmission revenues as a reduction to transmission cost of service; removal of the option for municipally owned utilities, river authorities, and electric cooperatives to use the cash flow method in establishing a transmission revenue requirement; requirements for municipally owned utilities, river authorities, and electric cooperatives in calculating transmission revenue requirement; a requirement for providing a cost comparison for actual cost versus cost estimates in the certificate of convenience and necessity; a requirement that utilities establish baseline transmission values in any litigated or stipulated base rate case, with failure to do so precluding an increase to transmission rates under an interim update; a requirement that ERCOT file monthly export data; a provision denying a utility from receiving an increase to transmission rates under an interim update if that utility over-earned on its most recent earnings monitoring report; a requirement that a utility update its accumulated deferred federal income taxes (ADFIT) under an interim update proceeding; a requirement that a utility update its most recent cost of debt in an interim update proceeding; a provision dismissing a utility's application for an interim update if that utility has a comprehensive base-rate proceeding pending or if the commission initiates a comprehensive case-rate proceeding within 60 days after the interim update application; and, a schedule requiring municipally owned utilities, river authorities, and electric cooperatives who have not had a full transmission rate proceeding within certain timeframes to apply for a transmission base-rate proceeding.
