Access Line Rates

Background: HB 1777 went into effect on Sept 1, 1999. As of March 1, 2000, all telecommunications franchise fees in Texas are required to be based on a fee-per-access line method. The PUCT, in October 1999, established three categories of access lines - residential, non-residential, and point-to-point. Each city was required to submit its 1998 base amount and allocation of the base amount to the PUCT by Dec. 1, 1999. All CTPs were required to submit a city-by-city, December 31, 1998 access line count to the PUCT by January 24, 2000. The PUCT then calculated maximum access line rates for the three categories of access lines, for each city. The rate for each category, when multiplied by the number of lines in that category in a city, should equal that city's base amount.

History of Rates: In March, 2000, the PUCT established maximum initial access line rates for 1106 cities. These cities were then allowed to 1) exempt life-line customers, 2) choose lower rates, and 3) update base amounts and allocation formulas. CTPs were allowed to update line counts and petition unreasonable initial allocations. In response to this input from cities and CTPs, the PUCT established final access line rates in April, 2000. CTPs were allowed to begin implementing these rates for the 2rd quarter of 2000 (April, May, June), but were required to begin implementing the rates by the 3rd quarter 2000 (July, August, September). State law allows a city to change its rates once a year, and its allocation once every 2 years. These changes must be initiated by the city each September and become effective the following January. CTPs may also petition the commission on unreasonable allocations in September of each year. The PUCT will also annually adjust the access line rates by half of the increase in the Consumer Price Index starting in 2002.
